Terms of Service

These terms of service govern your use of the Cool Runnings Sportfishing Charters website and your booking of any fishing charter with us. By booking a trip or using this website, you agree to these terms. Please read them carefully.

Booking and Deposit

A booking deposit is required to secure your trip date. The deposit amount and current pricing are quoted at the time of booking. The remaining balance is due on the morning of the trip, in cash or by card, before the boat departs the dock. Bookings are confirmed only after the deposit is received and the date is locked in writing or by phone.

Cancellations and Reschedules

Cancellations made more than seven days before the scheduled trip date may be eligible for a refund of the deposit, subject to processing fees. Cancellations made within seven days of the trip date may forfeit the deposit. Reschedules due to weather (called by the captain) are always at no charge, and your deposit applies to the new date. Reschedules requested by the guest within seven days are accommodated when possible but may be subject to availability.

Weather Policy

The captain has sole discretion to cancel or modify any trip based on weather, sea conditions, or any other safety concern. South Florida weather can change rapidly, and Captain Jason makes the call based on the morning forecast, offshore wave reports, and on-water observations. Weather cancellations called by the captain are rescheduled at no charge or refunded at the captain's discretion. Guests who refuse to fish in conditions the captain deems safe are not entitled to a refund.

Conduct on Board

By boarding the vessel, you agree to follow the captain's instructions at all times. The captain reserves the right to terminate any trip immediately, without refund, if a guest behaves in a manner that the captain considers unsafe, abusive, or destructive. This includes intoxication, drug use, harassment of crew or other guests, deliberate misuse of equipment, or any behavior that endangers the boat or its passengers.

Alcohol

Beer, wine, and cocktails are permitted on board in reasonable quantities. Guests are expected to drink responsibly. The captain may refuse to depart, return early, or refuse service to any guest who is excessively intoxicated. Glass containers are discouraged. Guests under the legal drinking age may not consume alcohol on the vessel under any circumstances.

Age Restrictions and Minors

There is no strict age minimum, but children under five generally do better on shorter, calmer inshore trips. All minors must be accompanied by a parent or legal guardian who is responsible for their safety and conduct. Coast Guard regulations require properly fitted life jackets for children, which we provide on board.

Liability and Assumption of Risk

Fishing is an outdoor activity that involves inherent risks, including but not limited to weather changes, sea sickness, slips and falls on wet decks, contact with hooks and fishing tackle, exposure to sun and heat, and the unpredictable behavior of fish and marine wildlife. By booking a trip, you acknowledge these risks and accept full responsibility for your own safety and the safety of any minors in your party.

To the maximum extent permitted by law, Cool Runnings Sportfishing Charters, its captain, crew, and owners are not liable for any injury, loss, or damage arising from your participation in a charter trip, except in cases of gross negligence or willful misconduct. You may be asked to sign a liability waiver acknowledging these terms before boarding.

Catch and Retention

All Florida and federal fishing regulations apply. The captain has the final say on which fish may be retained and which must be released, based on current size, bag, and seasonal regulations. Catch cleaning and bagging at the dock is included with every trip. Cool Runnings is not responsible for fish quality after the trip ends or for storage during travel home.

Personal Belongings

You are responsible for your personal belongings, including phones, cameras, sunglasses, wallets, and any other items brought on board. Cool Runnings is not liable for items lost, damaged, or destroyed during the trip. Bring waterproof cases or dry bags for valuables.

Photography and Media

We may take photographs or video during your trip for marketing purposes. By booking a trip, you grant Cool Runnings Sportfishing Charters permission to use these images on our website, social media, and other marketing materials without compensation. If you prefer not to be photographed, let the captain know at the start of the trip.

Governing Law

These terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any dispute arising from these terms or from a charter trip will be resolved in the courts of Broward County, Florida.

Changes to These Terms

We may update these terms from time to time. The date at the top of this page indicates when they were last revised. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
